So apparently the smoke shops I go to informed me that cbd made from marijuana is illegal in California but not if the cbd is made from hemp is legal! [Image: Jackie-Chan-WTF.jpg]
This is not true. Legal CBD oils can be bought anywhere in the US as long as it meets the 0.3% rule, or no more than 0.3% Delta 9 psychotropic agent per dried amount.
The law originated in 1937 and was then modified in he early 1970's. We are seeing a changing in the laws, but so far the wording has not changed. I apologize for the cut and paste but here is the 1937 wording...

The term “marihuana” means all parts of the plant Cannabis sativa L. [sic], whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin. Such term does not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil or cake, or the sterilized seed of such plant which is incapable of germination.

Notice the seeds and stems are not included in the wording, and until 1976 possession of seeds and stems was not illegal... Yes lawyers will argue but in reality if you were caught with a bag of seeds or stems, you were not breaking the law in the mid 70's

Mid 70's the taxonomy books were published, as again hemp was being used to make rope, clothing body oils etc.....You will still find them on the shelves on the stores, and they are legal. Understand though that the Hemp Oils and Oil pressed from hempseed contains no CBD, no THC, no plant cannabinoids to speak of, but it’s excellent for making varnish, paint, soap, nutraceuticals, and much more. (quoted from the law book)

However..... there are strains of the plant that are grown and modified to contain low doses of (Delta9) in the stalks, and in a few strains the leaves. This is not commonly grown, as your local dispensary is concentrating on high cbd and (Delta 9)

But you need to make sure you have the rights to transport across state lines.

Back to the question in California you might try the Disp Blum .... (I am not promoting any single group, just who I know has the option) The "barista" may not understand why you are looking for something like that, and will tell you they do not carry it, but if you have them contact the cultivator of have them speak with the owner "D" It is available.

To anyone else beware... most hemp oils are fake. Read the label carefully. CBD does not come from seeds.... It can come from the stalk, but it takes a great amount to produce only one ounce.

If your seller cannot provide you with a certificate of chemical structure, and purity, dont buy ....... CBD also is only stable in specific oils
Look for the additives.. Natural terpinoids and Vegetable oils only.. There should be no preservatives.
The box or vial must be marked not for sale under 18...

if its a GI problem you have then don't Vap the product... it can be ingested.

There are also different strains of oils....(Coming from the newest research) that promote a different responses. Quite complex..

Really a bummer to say that the Feds wanna crack down on all forms of herb. Cbd or thc they seem to have a witch hunt out for them. Some states that have passed recreational laws are now under the gun also. Seems our current administration wants to go back to the medical only. Which puts us right back at square one. Honestly the amount of lab testing it requires to find out what's thc vs Cbd is just too costly. Most people would just label the contents Cbd and the feds still won't care and bust you. This isn't the case where I live. But as soon as I leave the state it's treated like heroine. Pretty sad that a medicine that can treat severe diseases is vilified. Let's hope things change for the better.
