Found some very heated discussions about rape in this city. How it seems to be accepted in the courts.
Most of the comments were deleted and had been made by people whom favored this decision.
I have included two comments here. One rational woman searched all over google for news of the actual case. It seems to be missing. Even the citation she quoted to the case has been deleted now. Did not work.
Whom the hell is this perpetrator? They had a treasure trove of evidence. Or, is it the mentality of the judge?

In taking the girls off the street, forcing her into a car and holding her against her will, even without the rape, he committed kidnapping and false imprisonment. I cannot see any reason why the prosecutor could not have charged him under those statutes. Those statutes carry much heavier penalties, around 10 years apiece if memory serves. If the judge had an opportunity to impose a sentence under those statutes, he could have done much more. I have a feeling despite the creepy way this guy looks and his horrendous crime, he might be connected in some way or be a CO. Just a suspicion, I have no evidence to support my suspicion.

The statute this p.o.s. was convicted under allows a judge to stay the sentence and place the defendant on probation IF the judge finds that "(a) a stay is in the best interest of the complainant or the family unit; and (b) a professional assessment indicates that the offender has been accepted by and can respond to a treatment program." Minn. Stat. 609.344, subd. 3." How the hell does probation ever benefit the victim in this sitch? And what about the rest of us?!

Ok, normally a rape conviction is more likely to stick if perp steals from u. He stole her phone. And, if he moves victim even two inches before the rape. Not to mention false imprisonment.
I really feel badly for this poor girl. This happened on feb. 2015. She went to hospital, to police. Was a credible witness. Semen matched perp's DNA.
Most victims of rape do live in fear that perp will come back and get them again. So they cannot testify. Or, because they know how to gain access to them now.
I am sure this girl was begging God that perpetrator be put away. For a long time.
I don't see how she can begin to recover when the criminal is allowed his freedom while she will remain inside Her Hell for Possibly a Lifetime.
We seem to look the other way when college frat boys whom are on athletic teams date rape fellow students.
It is cases like this that make a woman feel its a useless, dangerous and humiliating event to even try to prosecute for rape.
